This was an action of trespass vi et armis, brought by the plaintiff against the defendant, in the circuit court for the county of St Louis, in the state of Missouri, for the purpose of trying the right of the plaintiff to freedom. The general issue was pleaded, and a verdict found for the defendant. The judgment on this verdict was carried by appeal to the supreme court for the third judicial district, where it was affirmed. This judgment has been brought into this court by writ of error.
